Minneapolis Police say the two toddlers that fell from an apartment building Thursday were brothers. One of the boys was killed from the fall.

John Elder is spokesman for Minneapolis Police.  He says the fall appears to be accidental and says it's unlikely that charges will be filed.

"The children were being watched by an adult.  That adult certainly seems capable.  There is no indication that drugs or alcohol played any part of the children going off of the building."

The boys fell 55 feet from the apartment complex onto a patio after climbing over a barrier.

The child who survived was upgraded from critical to serious condition Friday.
