75-year-old victim of bus assault dies; charge upgraded to murder

It becomes Minneapolis's 39th homicide this year

The 75-year-old man assaulted after getting off a Metro Transit bus last week has died.

Leroy Davontay Davis-Miles, 23, of Minneapolis, is charged with second-degree murder in the man's beating Nov. 6 near Chicago and Lake. He was originally charged with first-degree assault.

According to the criminal complaint, Davis-Miles followed the victim off the bus after he told Davis-Miles and his friends to lower their voices on the bus. Prosecutors say witnesses and surveillance video show Davis-Miles allegedly punching the victim once. He then fell to the ground and hit his head on the pavement, sustaining a serious brain injury. Davis-Miles was arrested the next day using what the Hennepin County Attorney's Office called "facial recognition software."

This marks the city's 39th homicide this year. Davis-Miles remains jailed on $150,000 bail.
